Final Paper

In Scott Shapiro's paper on the Hart-Dworkin debate, he begins a reconsideration of the debate in Section 4.  In your paper, explain Shapiro's understanding of the problem of theoretical disagreement in law.  Why does Shapiro take the problem seriously?  Why is it a deep difficulty for positivism?  You will need to recap Sections 4-5.  End your paper by arguing either for or against the reality of theoretical disagreement about the law.  If you argue against it, you may use Shapiro's response, or one of your own.  If you argue for it, you will need to supplement Dworkin or defend him against an important, relevant objection.
